Privacy Policy

Effective Date: 21 January 2026

Perspective Mediation (“we”, “our”, or “us”) is committed to protecting your privacy. This policy explains how we process personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, specifically regarding our Fixed-Fee Remuneration Protocol and Agency service guarantees.

Data Controller

The Data Controller responsible for your personal data is Perspective Mediation, Berwyn House, Meir Heath, ST3 7LP.

1. The Data We Collect

We collect and store data necessary for case assessment and professional facilitation of mediation, including:

  • Identity & Contact Data: Details provided via our Resolution Gateway for the Enquiring Party, and contact details for the Joining Party to facilitate initial contact and invitations.
  • Case Documentation: Supporting documents, evidence, and “Mediation Bundles” uploaded by the parties to enable the Mediator to understand the dispute.
  • Assessment Data: Information gathered during our Free Case Review and subsequent Viability Assessment used to determine if a case is suitable for professional facilitation.
  • Outcome & Audit Data: Information regarding substantial consensus and the 21-day settlement reflection window.

2. Legal Basis for Processing

  • Contractual Necessity: To perform services under the Mediation Agreement v2026.5.
  • Legitimate Interests: To facilitate the resolution of disputes and encourage the use of mediation (as supported by the UK Court system).
  • Neutrality Safeguard: To verify that our Faculty remains impartial and that mediators are remunerated accurately based on the guaranteed fixed-fee protocol.
  • Legal Obligation: For professional record-keeping and regulatory compliance.

3. Disclosure & The Faculty Firewall

To ensure absolute neutrality, we operate a structural firewall:

  • Faculty Sharing: We share identity, case documentation, and viability assessment data with your appointed Mediator. However, the commercial “No Agreement, No Fee” arrangement between you and the Agency is firewalled to ensure the Mediator remains outcome-blind.
  • Quality Audits: We may use your contact details to invite you to provide outcome-blind feedback to verify the procedural integrity and neutral nature of the mediation process.

4. Data Retention & Confidentiality

  • Mediation Bundles & Uploads: Case-specific documents are retained only for the duration of the process and the 21-day reflection window, after which they are securely deleted, unless required for legal record-keeping.
  • Mediator Notes: These are typically destroyed following a session. However, we retain notes where necessary to verify “Substantial Consensus” in cases of professional fee recovery.
  • Accounting & Record Keeping: Basic case instruction logs and instruction data are retained for 6 years for tax and regulatory purposes.

5. Information Provided About Third Parties

When an Enquiring Party provides the contact details of a Joining Party, we use that information solely to invite the Joining Party to participate in a Free Case Review. We inform the Joining Party where we obtained their data during our first point of contact. If the Joining Party declines to participate, their contact data is removed from our active systems within a reasonable timeframe.

6. Your Rights & Security

You have the right to access, correct, or erase your data, and to object to processing based on legitimate interests. For any queries, please contact info@perspectivemediation.co.uk.
