Perspective Mediation • v2026.5

Mediation Agreement

(Terms and Conditions)

Introduction & Structural Independence

This agreement establishes the professional framework for your mediation. To ensure the highest standards of impartiality, Perspective Mediation operates under a strict Fixed-Fee Remuneration Protocol.

The Parties acknowledge that the appointed Mediator (whether the Agency Principal or a member of the Faculty Panel) is remunerated by the Agency on a guaranteed fixed-fee basis for the session. This professional fee is earned for the facilitation of the process and is independent of the Agency’s ability to recover its separate professional fee from the Parties. This ensures the Mediator remains “outcome-blind” and has no financial interest in the dispute’s conclusion.

1. THE AGENCY AND THE MEDIATOR

The Agency (Perspective Mediation) agrees to appoint a qualified Mediator to facilitate the dispute. The parties acknowledge that:

  • The Agency may appoint the Agency Principal or a vetted Panel Mediator to lead the session.
  • The Mediator acts as an independent neutral facilitator; they do not provide legal advice or representation.
  • The Mediator’s role is to assist the parties in exploring a resolution while maintaining strict impartiality.
  • Participation is voluntary; parties agree to engage in the process in good faith and with full autonomy.

2. THE “NO AGREEMENT, NO FEE” GUARANTEE

The Agency’s professional fee is payable only upon reaching Substantial Consensus, achieved when:

  • Parties reach consensus on the primary issues (confirmed verbally or via Heads of Terms); or
  • A settlement is reached within the 21-day reflection window following the session.

The “No Agreement, No Fee” risk is held exclusively by the Agency as a commercial service guarantee. This model is designed to align the Agency’s interests with a successful process while ensuring the Mediator remains free from any outcome-contingent influence.

3. DISBURSEMENTS & IN-PERSON COSTS

The fee guarantee applies exclusively to the Mediator’s professional fee. For in-person sessions, the following disbursements remain the responsibility of the parties regardless of outcome:

  • Travel Fees: Charged at £100 per hour, per party (unless otherwise agreed).
  • Venue & Logistics: Parties are responsible for all venue hire costs and reasonable overnight accommodation for the Mediator if required.

4. AUTHORITY TO SETTLE

Parties warrant they attend with full authority to settle. Representatives for organisations confirm they have authorisation to agree to binding terms during the session.

5. FREE CASE REVIEW & CANCELLATION

Once a case moves from the free review stage to a scheduled session, cancellation fees apply to cover preparation work: 48 hours notice for disputes up to £100k; 7 days for disputes over £100k. Cancellation within these periods incurs a fee of 25% of the full professional fee.

6. CONFIDENTIALITY AND PRIVILEGE

Mediation is conducted on a ‘without prejudice’ basis. Information shared cannot be produced as evidence in legal processes. Parties agree not to call the Mediator as a witness. Privilege is waived solely if the Agency must prove consensus for fee recovery purposes.

7. LEGAL STATUS AND ADVICE

The Mediator is not a legal advisor. Any comments regarding legal issues are for facilitation only. Parties are encouraged to consult their own legal representatives regarding settlement terms.

8. ACKNOWLEDGMENT OF PARTY AUTONOMY

The Parties accept this financial model as a professional safeguard designed to ensure the mediator’s impartiality. By entering into this agreement, the Parties confirm they have been informed of the Mediator’s fixed remuneration structure and are satisfied that it preserves the Mediator’s independence. The Parties retain absolute authority over the outcome and maintain the “Freedom of No” regarding any settlement proposal.

9. TERMINATION OF MEDIATION

A party may withdraw at any time after the opening session. The Mediator may terminate the process if they believe resolution is unlikely or if ethical concerns arise.

10. INDIVIDUAL LIABILITY FOR FEES

Each party is individually responsible for their own mediation fee and disbursements. Invoices are payable within 7 days. Late payments may incur interest at 8% above the Bank of England base rate. Gold and Silver Tier instructions are subject to individual invoicing terms.

11. DATA PROTECTION & PRIVACY

Personal data is processed in accordance with the UK GDPR. Parties acknowledge that while case data is shared with the Mediator, commercial fee data is firewalled to maintain mediator outcome-blindness.

For full details on data rights and our quality audit process, please refer to our Privacy Policy.

12. COMPLAINTS & GOVERNING LAW

Complaints should be directed to the Agency. This Agreement is governed by the laws of England and Wales, with the courts of England and Wales having exclusive jurisdiction.

13. DIGITAL ACCEPTANCE

This is a legally binding contract. Terms are accepted when an online instruction form is submitted with the confirmation box ticked, or when a party confirms acceptance via email.
