FIVE STEPS OF MEDIATION
STEP ONE: Initial Contact and Agreement to Mediate
The process begins when both parties agree to mediation as the preferred method of resolving their dispute. Once an agreement to mediate is signed, the mediator facilitates the process.
STEP TWO: Preparation and Pre-Mediation Meetings
The mediator meets with each party separately to discuss their concerns, goals, and expectations for the process. This ensures everyone feels heard and helps the mediator understand the issues at hand.
STEP THREE: Mediation Sessions
The mediator facilitates the core discussions in joint or separate sessions (known as caucusing, if necessary). These conversations are guided to encourage open communication, explore possible solutions, and identify points of compromise.
STEP FOUR: Finding Common Ground
The goal isn’t for one party to “win” or the other to “lose.” Instead, mediation focuses on identifying a resolution that both sides feel is fair and workable. Guided by the mediator, each party is encouraged to propose solutions and ultimately shape the final agreement.
STEP FIVE: Reaching Agreement (or Not)
If all parties come to an agreement during mediation, the mediator can assist in formalising this in writing through a Memorandum of Understanding (MOU). If a MOU serves as a clear record of the parties’ agreed terms it can be enforceable and can be incorporated into a contract or court order.
The Role of the Mediator
The mediator is not a judge or an arbitrator. They don’t make decisions for you or enforce outcomes. Instead, they act as an impartial guide, helping parties communicate effectively, remain focused on solutions, and navigate challenging conversations. At Perspective Mediation, our approach is rooted in empathy, understanding, and professionalism. Our mediator combines decades of expertise in legal disputes with specialised training in conflict resolution to help you find fair and balanced outcomes—even in the most difficult of cases.
Why Mediation Agreements Are Respected More Than Court Orders
One of the key advantages of mediation is that agreements are created collaboratively, with input from everyone involved. Unlike court orders, which are imposed externally, mediated agreements are voluntary and designed to meet the needs of both parties. Because both sides play an active role in shaping the agreement, there’s a greater sense of ownership and commitment to honouring the terms. In fact, it’s been shown that parties are more likely to comply with mediated agreements compared to court imposed outcomes.
