The Procedural Stages

A structured framework designed to move parties from entrenched positions to commercial consensus.

Stage 1

Pre-Mediation Submission

Prior to the day, both parties submit a concise summary of their position and key documents. This allows the mediator to understand the core issues and legal landscape before the clock starts.

Stage 2

The Opening Joint Session

Typically, the day begins with all parties in one room. The mediator establishes the ground rules, and each party is given uninterrupted time to make an opening statement outlining their perspective.

Stage 3

Private Caucus (The Engine Room)

Parties retire to private rooms. The mediator shuttles between them, testing the reality of positions, exploring confidential settlement options, and challenging weaknesses in a safe, private environment.

Stage 4

Substantial Consensus

The process concludes when substantial consensus is achieved on the primary issues. While this is typically recorded in a Heads of Terms document to assist legal drafting, the consensus itself (whether confirmed verbally or in writing) marks the successful resolution of the dispute and the completion of the mediation process.
