The Principles of Mediation

The mediation process is built upon five pillars that ensure safety, neutrality, and control. These principles apply to every session we convene.

1. Voluntary Participation

Mediation is strictly voluntary. Every party enters the process willingly and retains the absolute right to withdraw at any stage without penalty or prejudice.

2. Impartial Neutrality

The mediator is an independent third party. They do not take sides, offer legal advice, or judge the merits of the case. Their sole focus is facilitating a commercial consensus.

3. Without Prejudice

Our mediation process is conducted on a ‘Without Prejudice’ basis. This creates a safe, confidential environment where all parties can speak freely and explore settlement options. This allows for the open, honest dialogue necessary to reach a resolution.

4. Self-Determination

The mediator does not impose a decision. The parties retain total control over the outcome. Substantial consensus is achieved when the parties mutually agree on the core terms of resolution, regardless of whether that agreement is immediately formalised into a deed.

5. Confidentiality

The process is strictly private. Nothing shared with the mediator is disclosed to the other party without explicit permission, ensuring frank and open negotiation. Limited exceptions apply solely regarding the recovery of professional fees as outlined in our Terms.
